These Terms of Use govern your access to and use of the Swappo platform (swappo.ae), operated by Hannibal General Trading - L.L.C - S.P.C (Registry No. 6158841, Economic Licence No. CN-5592284), a Limited Liability Company - Sole Proprietorship Company registered with the Abu Dhabi Registration Authority (ADRA), Department of Economic Development, Abu Dhabi, UAE.

1. Platform Description

Swappo is a peer-to-peer barter and exchange platform that allows users to swap physical items with other users. The platform operates as an intermediary facilitator only. Swappo is NOT a party to any exchange transactions and does not buy, sell, or own any items listed on the platform.

2. Use of Service & User Eligibility

By accessing and using Swappo, you agree to be bound by these Terms of Use. You must be at least 18 years old or the legal age of majority in the United Arab Emirates, whichever is greater. You are solely responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying Swappo of any unauthorized access to your account
Complying with all applicable laws and regulations in the UAE

3. Account Registration & Responsibilities

To use Swappo, you must create an account by providing accurate, complete, and current information. You are responsible for the accuracy of information you provide and for keeping it updated. You agree not to:

Create multiple accounts or impersonate another person
Use automated tools or bots to access the platform
Use the platform for any illegal or fraudulent purpose
Provide false or misleading information

4. Anonymity & Identity Reveal Mechanism

Swappo operates on a principle of user anonymity until a swap is mutually accepted. Key terms:

Users remain anonymous until both parties mutually accept a swap
Identity (name, profile photo) is revealed AUTOMATICALLY when BOTH parties accept the swap — at no additional cost
Each accepted swap consumes 1 swap from EACH participant's monthly quota (as determined by their subscription plan)
Chat opens automatically after identity reveal, allowing both users to coordinate the exchange
Until mutual acceptance, all browsing and proposals remain fully anonymous

5. Subscription Plans

Swappo operates on a subscription-based model. Access to swap features is determined by your subscription tier.

5.1 Subscription Tiers

Free — 2 swaps per month, 1 giveaway claim per month, ads displayed
Bronze (19 AED/month) — 4 swaps per month, 2 giveaway claims per month, 1 boost per month, reduced ads
Silver (39 AED/month) — 6 swaps per month, 3 giveaway claims per month, 2 boosts per month, reduced ads
Premium (69 AED/month) — Unlimited swaps per month, 5 giveaway claims per month, 4 boosts per month, no ads

5.2 Billing & Payment

Subscriptions are billed monthly via Apple Pay, Google Pay, credit/debit cards, or Tabby installment plans
Subscriptions auto-renew unless cancelled before the renewal date
Payment is processed securely through third-party payment providers
By subscribing, you authorize Swappo to charge your selected payment method on each renewal date

5.3 Quota & Renewal

Your monthly swap quota resets on your signup anniversary date each month
Unused swaps do NOT carry over to the next month
On downgrade, the new (lower) quota applies starting from the next billing cycle
Active swaps in progress at the time of downgrade remain active and are not affected

5.4 Cancellation & Refunds

Cancellation can be done at any time in-app or by contacting support
Cancellation takes effect at the end of the current billing period — you retain access until then
No pro-rata refunds are provided for the remaining portion of a billing period
Swappo may change subscription prices with 30 days' prior notice to subscribers

6. Listing Rules & Structured Fields

To maintain platform safety and user anonymity, all item listings must follow strict guidelines:

Listings use structured form fields only (category, condition, item type, photos) — NO free-text descriptions
You must NOT attempt to circumvent the anonymity system by revealing contact information (phone, email, address, social media handles) in listing fields, photos, or any other manner
You must NOT use coded language or hints to share contact details
Violations result in immediate listing removal and account suspension
Structured fields ensure safe, moderated, and anonymous exchange facilitation

7. Prohibited Items

The following items and content are strictly prohibited on Swappo and will result in immediate removal and potential account suspension:

Weapons (firearms, knives, explosives, ammunition)
Drugs and controlled substances
Adult toys and sexually explicit items
Nudity or sexually explicit photos/videos
Counterfeit or replica branded items
Prescription medications (unless sold by licensed pharmacies)
Stolen goods or items of unclear origin
Items that violate UAE law or Islamic principles
Any hazardous materials without proper licensing

8. Content Moderation & AI Detection

Swappo uses automated AI photo detection and user reporting to enforce prohibited item policies:

All photos are scanned using AI vision technology (Google Vision / AWS Rekognition) to detect weapons, nudity, drugs, and other prohibited content
Users can report inappropriate listings or user behavior directly in-app
Three (3) user reports on an account result in automatic suspension pending review
Swappo reserves the right to manually review flagged content and make final moderation decisions
Repeat violations result in permanent account termination

9. Giveaway System

Swappo allows users with a Badge ⭐ (at least 1 completed swap) to offer items as giveaways. Terms:

Only users with a Badge ⭐ (1 or more completed swaps) can list or claim giveaway items
Giveaway claims are limited by your subscription plan: Free (1/month), Bronze (2/month), Silver (3/month), Premium (5/month)
After claiming a giveaway in a category (e.g., Electronics), that user cannot claim another giveaway in the same category for 30 days (anti-reseller protection)

10. In-App Chat & Communication

All communication between users must occur through Swappo's in-app chat only:

Users are NOT permitted to share phone numbers, email addresses, URLs, social media handles, or any contact information in the chat
Swappo's system automatically filters and blocks known contact information
Chat messages are encrypted and only visible to the two parties in the conversation
Chat history is deleted when an account is deleted
Attempting to circumvent the chat filter results in account warning, suspension, or termination
Swappo reserves the right to review chat content to enforce safety policies

11. User Conduct & Prohibited Behavior

You agree not to engage in any of the following:

Fraud, scams, or deception (e.g., bait-and-switch, selling broken items as working)
Fake listings or uploading photos of items you don't own
Harassment, abuse, discrimination, or threats toward other users
Attempting to manipulate the rating or review system
Spam or excessive promotional messaging
Using the platform for money laundering or illegal activity
Reverse-engineering or attacking the Swappo application

12. Item Condition & Buyer Beware

IMPORTANT: Swappo facilitates exchanges but is NOT responsible for:

The quality, condition, safety, or functionality of any item listed
Whether items are as described or as shown in photos
Defects, hidden vices (vices cachés), or damage not visible in photos
The legal status of items (authenticity, stolen goods, etc.)
Compliance with any standard or regulation

Users are responsible for verifying item condition IN PERSON during the meetup before completing the exchange. Examine items thoroughly, test functionality, and ask questions. Swappo recommends meeting in safe public places, but is NOT liable for personal safety incidents.

13. Meeting & Safety

When meeting another user to exchange items:

Meet only in safe, well-populated public locations (shopping malls, public parks, etc.)
Bring a friend if possible
Inspect the item thoroughly before agreeing to exchange
Complete the exchange in person and verify both parties are satisfied
Swappo provides meetup recommendations but is NOT responsible for your personal safety or security
You meet other users entirely at your own risk

14. Rating & Reviews

After completing an exchange, users may rate each other on a scale of 1-5 stars. Important terms:

Ratings reflect the user's experience with the other party
False or manipulated ratings may result in account suspension
Ratings are visible to all users and affect trust on the platform
Users may report inappropriate or false ratings for review

15. Intellectual Property

All intellectual property owned by Swappo, including but not limited to:

The Swappo brand name, logo, and handshake icon
Website design, layout, and functionality
Mobile app code and design
Original content, text, and graphics

...are protected by copyright and trademark law. You may not reproduce, distribute, or use Swappo's IP without written permission.

16. Subscription Tiers — Detailed Terms

Swappo offers four subscription tiers:

16.1 Free Tier

2 swaps per month
1 giveaway claim per month
0 boosts per month
Newcomer badge
Ads displayed on the platform

16.2 Bronze (19 AED/month)

4 swaps per month
2 giveaway claims per month
1 boost per month
Bronze badge
Reduced ads

16.3 Silver (39 AED/month)

6 swaps per month
3 giveaway claims per month
2 boosts per month
Silver badge
Reduced ads

16.4 Premium (69 AED/month)

Unlimited swaps per month
5 giveaway claims per month
4 boosts per month
Premium badge
No ads on the platform

16.5 Cancellation

You may cancel your subscription at any time via in-app settings or by contacting support
Cancellation takes effect at the end of the current billing cycle — you retain benefits until then
No refund is provided for the current billing period upon cancellation
After cancellation, your account reverts to the Free tier

17. Boosts & Promotions

Users may purchase boosts to promote their listings and increase visibility. Terms:

Boosts are included in paid subscription plans
Boosted listings appear higher in search results and category feeds for a limited time
All boost purchases are final and non-refundable
Swappo reserves the right to adjust boost pricing and duration

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Swappo provides the platform "AS IS" without warranties of any kind
Swappo is NOT liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of money, items, data, or reputation
Swappo's total liability is limited to the amount of subscription fees paid by you in the past 12 months
Some jurisdictions do not allow liability limitations; this clause is enforced to the maximum extent allowed by law

19. Account Suspension & Termination

Swappo reserves the right to suspend or terminate any account at any time, with or without notice, if:

You violate these Terms of Use
You engage in fraud, scams, or illegal activity
You receive three user reports for violations
You repeatedly violate prohibited item policies
You attempt to circumvent safety systems (anonymity, chat filters, moderation)
Swappo deems your account a risk to other users or the platform

Upon termination:

Your account access is revoked immediately
Any active subscription is cancelled without refund for the current billing period
All active listings are removed
You may not create a new account to bypass the suspension

20. Governing Law & Dispute Resolution

Swappo is operated by Hannibal General Trading - L.L.C - S.P.C (Registry No. 6158841, Economic Licence No. CN-5592284), licensed by the Abu Dhabi Department of Economic Development for the following activities: E-Commerce Through Websites, E-Commerce Through Social Media, and General Trading.

These Terms of Use are governed by the laws of the United Arab Emirates, including Federal Decree Law No. 14 of 2023 (E-Commerce) and Federal Law No. 15 of 2020 (Consumer Protection)
Any disputes arising from your use of Swappo shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE
For disputes, contact Swappo support at ahmed.kridis@gmail.com with details of the issue
Swappo will attempt to resolve disputes in good faith within 14 days
If unresolved, either party may escalate to the competent courts in Abu Dhabi, UAE

21. Changes to Terms

Swappo may modify these Terms of Use at any time. Changes will be notified to you via:

Email notification to your registered account email
In-app notification when you next log in
A new "Last Updated" date on this page

Continued use of Swappo after changes constitutes acceptance of the new Terms.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

By using Swappo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
